Winter Weather
02.03.2026-- The Federal Motor Carrier Safety Administration (FMCSA) has issued an Extension of Regional Emergency Declaration No. 2026-001, effective February 3, 2026, in response to the ongoing impacts of severe winter storms and below-normal temperatures across much of the United States.
This extension remains in effect through 11:59 PM (ET), February 20, 2026, or until the end of the emergency, whichever occurs first.
01.30.2026-- Governor Ron DeSantis has issued Executive Order 26-16, which has enacted the provisions from Executive Order 24-214, as amended by Executive Order 24-215, for 60-days from January 23, 2026. These provisions authorize the Executive Director of Florida Highway Safety and Motor Vehicles and the Secretary of the Florida Department of Transportation to waive/suspend specific requirements temporarily to prepare and recover from disruptive events such as natural disasters.
Due to the nature of the event, the Florida Department of Highway Safety and Motor Vehicles Executive has not issued an Emergency Order to enact the provisions of 49 CFR 390.23 at this time. Should conditions necessitate an Emergency Order, we will provide direction in a follow-up email.
Florida Department of Transportation Secretary Jared Perdue has Authorized FDOT Emergency Order 26-01 which is described below:

FDOT Emergency Order 26-01: Waives/suspends size and weight laws for divisible loads transporting emergency equipment, services, supplies, or personnel; FEMA mobile homes or office style mobiles homes; and agricultural commodities and citrus (identified in FDOT Enforcement Bulletin 1-28-2026 – Freeze thru 2-6-2026 Ag Designations) as long as the vehicle is transporting and complying with an active corresponding Emergency Road Use Permit Letter (ERUP). Note- if the vehicle(s) is transporting cargo that is categorized under the Emergency Road Use Permit but the driver does not have a permit, you should print and provide a copy of the ERUP to the driver and not take enforcement action for not being in possession of the ERUP alone.

FDOT Enforcement Bulletin 1-28-2026 – Freeze thru 2-6-2026 Ag Designations: Provides the list of agricultural products designated to be transported under the ERUP through February 6, 2026. Note- It is common to have the Commissioner of Agriculture include additional agriculture throughout an emergency event. We will provide updates to the list as they are provided to FLHSMV.

When the Governor of Florida issues an state of emergency, FDOT and others allow certain trucking regulations to be temporarily relaxed or lifted. These apply to road use, size and weight restrictions, hours of service and other issues.

01.10.2025-- FMCSA Regional Emergency Declaration- Heating Fuel
FMCSA No. 2025-001- Expires 01/31/2025.​
The FMCSA has issued Regional Emergency Declaration No. 2025-001, which provides relief from maximum driving time regulations (49 CFR § 395.3) for motor carriers and drivers providing direct assistance in transporting heating fuels (propane, natural gas, and heating oil) across 49 states and DC in response to severe winter storms and extreme temperatures. This exemption is effective immediately through January 31, 2025, though drivers must still comply with all other safety regulations, including drug and alcohol testing, CDL requirements, and insurance requirements.
MEMORANDUM: EXECUTIVE ORDERS 24-212 & 24-213 and DBPR ORDER 2024-9
10. 3. 2024 Governor Ron DeSantis issued Executive Order (EO) 24-212 and Executive Order (EO) 24-213. Governor DeSantis also directed the Department of Business and Professional Regulation (DBPR) to issue Order 2024-09. Executive Order 24-213 issues directives to the Florida National Guard, Florid State Guard, Department of Transportation, and the Florida Department of Highway Safety and Motor Vehicles to take certain actions to mitigate potential disruptions caused by ongoing port strikes to the supply chain and those recovering from Hurricane Helene. Executive Order 24-212 pertains to actions to ensure election activities are not disrupted by Hurricane Helene. DBPR Order 2024-9 pertains to alleviating rental length restrictions for individuals seeking shelter who lost their homes due to Hurricane Helene.
